These Terms of Service (“Terms”) govern your use of the FPM Gunworks website located at fpmgunworks.com and your purchase of products from us. By accessing our website or placing an order, you agree to be bound by these Terms.

1. Eligibility

By using this website and purchasing our products, you represent and warrant that:

• You are at least 18 years of age, or 21 years of age where required by applicable law
• You are legally permitted under federal, state, and local law to purchase, possess, and receive the products you are ordering
• You are not prohibited by any federal, state, or local law from purchasing or possessing firearms, firearm components, or NFA-regulated items
• All information you provide to us is accurate and complete

We reserve the right to refuse service to anyone who does not meet these eligibility requirements.

2. NFA and ATF Compliance

FPM Gunworks sells products that may be regulated under the National Firearms Act (NFA) and subject to oversight by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Certain products — including suppressors — require compliance with federal transfer procedures, including submission of the appropriate ATF forms and approval prior to transfer. As of January 1, 2026, the $200 federal transfer tax on suppressors and most NFA items has been eliminated, though the registration and approval process remains in full effect.

It is your sole responsibility to understand and comply with all applicable federal, state, and local laws prior to purchasing any regulated product. By placing an order, you certify that your purchase is lawful in your jurisdiction and that you will comply with all applicable regulations.

FPM Gunworks is not responsible for purchases made in violation of applicable law, and reserves the right to cancel any order that we believe may violate federal, state, or local regulations.

3. Product Use and Safety

All products sold by FPM Gunworks are intended for lawful use only. Products must be used in accordance with all applicable laws and in compliance with manufacturer instructions, specifications, and safety guidelines.

Improper installation, modification, misuse, or use of incompatible components may result in serious injury, death, or property damage. By purchasing our products, you acknowledge these risks and agree to use all products safely and responsibly.

4. Pricing and Payment

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors at any time. Payment is due at the time of purchase. We accept payment methods as displayed at checkout.

We reserve the right to cancel orders in the event of pricing errors, suspected fraud, or unavailability of product.

5. Shipping and Transfers

All shipments are subject to applicable federal, state, and local laws, including ATF and NFA regulations. NFA-regulated items (such as suppressors) cannot be shipped directly to customers and must be transferred through a properly licensed dealer (FFL/SOT) in accordance with ATF procedures. Customers returning NFA-regulated items should contact us before shipping — additional transfer requirements apply and we will guide you through the correct process for your product.

Shipping timelines are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, or circumstances beyond our control.

6. Returns and Refunds

Returns are subject to our warranty and return policy. Products must be returned in original, unused condition and with all original packaging. FPM Gunworks reserves the right to refuse returns that do not meet these requirements or that show signs of use, damage, or modification.

NFA-regulated items that have been transferred are generally non-returnable due to regulatory requirements. Please contact us before purchasing if you have questions.

7. Limitation of Liability

To the fullest extent permitted by law, FPM Gunworks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or website, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or your purchase shall not exceed the amount you paid for the product giving rise to the claim.

8. Disclaimer of Warranties

Except as expressly stated in our written warranty, all products are provided “as is.” We disclaim all implied warranties, including warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Foard County, Texas, and you consent to personal jurisdiction in those courts.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised effective date. Your continued use of the website following any changes constitutes your acceptance of the revised Terms.
